In a novel labor law case that other attorneys rejected, our client, a cleaner employed by a maintenance company, was injured when she fell from a step ladder while removing paint from above a door in a finished apartment in a building still under construction. As a result of the accident she injured her knee and underwent arthroscopic surgery. Defendants argued that our client’s case should be dismissed because at the time of her accident she was involved in general maintenance work which was not covered by the labor law and also because there was nothing wrong with the ladder that she was working. We were able to successfully counter defendants’ arguments and secure our client $750,000.
