In an extremely unique case, a 75 year old woman suffered third degree burns to her buttocks while using a massaging bed in defendant’s store. Our client not only alleged that the bed malfunctioned causing her burns but that the store workers held themselves out as therapists and told her that the heat she was feeling was part of the “therapy”.
